Terms of Service

These Terms of Service ("Terms") govern your access to and use of Monster Hunt ("the Game", "the Service"), operated by Samuel O'Regan ("we", "us", "the Operator"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2. Account and Access

2.1 Discord Account

The Service is accessed through Discord. You must have a valid Discord account and comply with Discord's Terms of Service.

2.2 Account Responsibility

You are responsible for maintaining the security of your Discord account. We are not liable for any loss or damage arising from unauthorized access to your account.

2.3 Account Suspension or Termination

We reserve the right to suspend, restrict, or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to:

• Violation of these Terms
• Cheating, exploiting bugs, or using unauthorized automation
• Harassment of other users or staff
• Fraudulent activity
• Any conduct we deem harmful to the Service or its community

Appeal Process: If your account is suspended or terminated, you may submit an appeal by contacting us at oresam@tuta.com. We will review appeals at our discretion, and our decision is final.

3. Virtual Items and Currency

3.1 License, Not Ownership

All virtual items, monsters, currency (including Essence), and other in-game assets are licensed to you, not sold. You do not own any virtual items. We retain all rights, title, and interest in and to the Service and all virtual items.

3.2 No Real-World Value

Virtual items have no real-world monetary value and cannot be exchanged for real currency, goods, or services.

3.3 Revocation

We may modify, suspend, or revoke virtual items at any time for any reason, including game balancing, policy violations, or service changes.

4. Purchases and Payments

4.1 In-Game Purchases

The Service may offer subscriptions, virtual items, or other purchasable content through our store.

4.2 No Refunds

All purchases are final and non-refundable. By making a purchase, you acknowledge that:

• You will not receive a refund for any reason
• Purchases are non-transferable
• Virtual items may be modified or removed at our discretion

4.3 Pricing

Prices are displayed in the applicable currency at the time of purchase. We reserve the right to change prices at any time.

4.4 Gift Codes

Gift codes purchased through the Monster Hunt Store are subject to the following terms:

• Validity Period: Gift codes are valid for one (1) year from the date of purchase. After this period, unredeemed codes will expire and become invalid.
• Single Use: Each gift code can only be redeemed once. Once redeemed, the code cannot be used again or transferred to another user.
• Non-Transferable After Redemption: While gift codes may be shared with any registered user before redemption, once redeemed, the gems are bound to the redeeming account.
• Redeemable by Purchaser: Gift codes may be redeemed by the original purchaser or shared with any other registered user.
• No Cash Value: Gift codes cannot be exchanged for cash, real currency, or refunded after purchase.
• No Refunds: Gift code purchases are final and non-refundable, consistent with Section 4.2.
• Notification: The original purchaser will be notified when their gift code is redeemed by another user.
• First Purchase Bonus: Redeeming a gift code counts toward the recipient's first purchase eligibility for bonus gems, where applicable.

5. Settlements

5.1 Settlements

A "Settlement" is a Discord server where Monster Hunt is active. When the Monster Hunt bot joins a Discord server, that server becomes a Settlement within the Game.

5.2 Settlement Registration

By adding the Monster Hunt bot to a Discord server, the server owner acknowledges and agrees that:

• The server will be registered as a Settlement in our systems
• Basic server information (server ID, name, icon, member count) will be collected and stored
• User activity within the Settlement may be tracked for gameplay purposes
• Settlement records are retained even if the bot leaves the server, for historical and analytical purposes

5.3 Settlement Bans

We reserve the right to ban Settlements from accessing the Service for violations of these Terms, including but not limited to:

• Organized exploitation or cheating
• Harassment of users or staff through the Settlement
• Fraudulent activity coordinated through the Settlement
• Violation of Discord's Terms of Service

Settlement bans may be temporary or permanent at our discretion. During a ban, the Monster Hunt bot will not function in the affected Settlement.

6. User Conduct

You agree not to:

• Use cheats, exploits, automation software, bots, hacks, or unauthorized third-party tools
• Exploit bugs or glitches (you must report them instead)
• Harass, threaten, or abuse other users
• Impersonate others or misrepresent your identity
• Attempt to gain unauthorized access to the Service or other accounts
• Engage in real-money trading of virtual items
• Interfere with or disrupt the Service
• Violate any applicable laws or regulations

7. Intellectual Property

7.1 Our Rights

The Service, including all content, graphics, code, and trademarks, is owned by or licensed to us. You may not copy, modify, distribute, or create derivative works without our express written permission.

7.2 User Content

By using the Service, you grant us a non-exclusive, royalty-free, worldwide license to use any content you submit (such as monster nicknames or profile information) for the purpose of operating and improving the Service.

8. Disclaimers

8.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8.2 No Liability for Loss

WE ARE NOT LIABLE FOR ANY LOSS OF VIRTUAL ITEMS, PROGRESS, OR DATA, WHETHER DUE TO TECHNICAL ISSUES, ACCOUNT SUSPENSION, OR ANY OTHER REASON.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Samuel O'Regan from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will make reasonable efforts to notify users of significant changes.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
